I acknowledge that he claims medical analysis of a body is difficult after 12 hours, but I question whether merely requiring reporting within 12 hours will actually lead to a medical exam of the body within pissed off 12 hours. Also, he claims "the bill in no way mentions miscarriages, only deliveries." In my view the word "delivery" is only operative for purposes of the pissed off timing provision. Failure to report fetal death is the operative provision for purposes of the criminal conduct. If anything, a woman who gives birth pissed off to a live baby and abandons it wouldn't be culpable under this provision, as there would not have been "fetal death." Only a woman who delivers a still-born child and fails to report it would be culpable under this provision.
