The LAW in play is the Kansas "Romeo and Juliet" law. If the persons involved had been OPPOSITE SEX consensual participants, would the law apply to THEM? If so, then it must apply in same sex instances as well. If the mental capacity would negate the use of this law in the case of same sex relationships, then of course the law should be applied equally in this aspect as well. Unfortunately, there is ample case law for "taking advantage of the mentally retarded", and in particular compliant females are prey for certain types of predators. |
