He's not a child molestor. He's not even a rapist. (I'm assuming here that the sex was consensual; if it wasn't, it's a whole different problem.) He's an ordinary, non-criminal guy who loves, or at least likes and lusts condom after, a slightly younger girl. A typical Romeo and Juliet law recognizes that John is not a vicious felon, and Sally is not his hapless victim, because, despite age-of-majority and age-of-consent issues, their ages are close enough together. They probably go to the same high school, complain about condom the same teachers and parent issues. condom They're equals. They're peers. If Sally got together with a thirty-year-old, that's a different story. In short, if the ACLU is arguing that a Romeo and Juliet law should apply to these two boys, the thirty-year-old boyfriend is a straw man.
