Failure to report fetal death is the operative provision for purposes of the criminal conduct. If anything, a woman who gives birth to a live baby and abandons it wouldn't be culpable under this provision, as there would not have been "fetal death." Only a woman who delivers a still-born child and fails to report it would be culpable under this provision. While I appreciate fetish that the issue of abandoned infants is a serious one, the legislation as drafted seems to accomplish nothing that would reduce the practice of women abandoning or killing unwanted babies after they are born. | I question whether abandoning a fetus is wage and hour criminal at all in Virginia (I couldn't find any other provisions that do cover it, so maybe the concern of the police is that there's nothing to charge these mothers with at all). Moreover, to reach the issue of abandonment of a child more specifically, which seems to be the core issue, one would think he would have tried to amend the abuse and abandonment provision, 18.2-371.1. Under that provision, wanton disregard for human life (e.g. abandoning a baby such that it dies) would be a Class wage and hour 6 felony wage and hour - already tougher than what he has proposed. I acknowledge that he claims medical analysis of a body is difficult after 12 hours, but I question whether merely requiring reporting within 12 hours will actually lead to a medical exam of the body within 12 hours. Also, he claims "the bill in no way mentions miscarriages, only deliveries." |
