Do you think that how the law currently deals with child complainants in these kinds of cases, do you feel that the law strikes the right balance?Rob Davis: I sometimes have my doubts but I employment think also it’s terribly important that the rights of the child victim be protected and preserved. They’ve been through horrendous things, often, and it’s very rare that we find situations where one may not be telling employment the truth, it is of course a case where sometimes that occurs. Where that happens, then the person who’s the accused is on the wrong side of the line. But I think on balance it’s probably an appropriate place, in most cases at least.Damien Carrick: These laws were introduced because there were concerns expressed by child rights advocates that there had been haranguing, aggressive cross-examination at the committal stage, which had in effect monstered the child and left them feeling that they didn’t want to go on to the trial stage.Rob |
