Carrick: What kind of charges compensation do you think he should be entitled to?Tim Meehan: Well given the way our society works, we can’t obviously give him that three and a half months of his life back that he spent in custody. The only thing that we can do is to compensate him with money. His time in custody is worth something, obviously; the fact that he charges lost his business is worth something.Damien Carrick: Now as a general rule, those acquitted by courts charges never get their legal costs covered or any other losses compensated.Tim Meehan: Certainly when you’re talking with respect to criminal matters in the superior courts that’s the case. Obviously the legislature in Queensland has, to a small degree, considered that costs should be awarded and certainly our Justices Act of 1886 does provide that if a matter is dealt with in the summary jurisdiction, so in the Magistrate’s Court, an accused person who is acquitted can in certain circumstances have costs paid to them.
