For years, Indian Health Services, the only health networking care to which most reservation Indians have access, has been kneecapped by the Hyde Amendment, which prohibits IHS money to be used for abortions, except in cases of rape, incest and life (but not health) of mother. However, since Indian reservations are not subject to state regulations and since abortion, according to the federal government, is still legal nationally, South Dakota could not regulate such private, Indian-owned clinics on tribal land.
