Her relationship does not fall into any of the categories I have named. Therefore, I say it can't be rape. The law is flawed and does not allow for these circumstances to be considered as mitigating. The law should have considered her situation as not falling into the category of rape. But the law is driven by chronological age only and states adults can't have sex with twelve to sixteen year olds or younger or it is automatically rape. |
