| So his control over the dossier gives him enormous power in relation to the outcome of the case at trial. And this seems to have been the problem here, in that he played fast and loose with the matter that should have gone into the dossier. One other example: one of the experts was called to look at the psychological profile of the accused persons, and he reported to the investigating judge that 14 of the 17 people who he’d tested psychologically, showed paedophilic tendencies. This was met by the defendants with a request for a counter expertise which the trial judge declined. So the only evidence of a psychological nature as to their likelihood in the commission of these offences, was this quite bizarre psychological report, and that was sort of very prejudicial evidence against them, particularly as no counter expertise was permitted by the judge.Damien |
